By Col. John Thomas Auctioneer
I have been in the auction circle for over 33 years. I stared out with my father working and selling at auctions at 14. I sold on the auction block for the first time at 18 in Kentucky. I have been licensed in NC and doing auctions for over 12 years on both ends of the state. I have conducted many types of auctions over the years from antiques & collectibles to good house wares.
With the state of the current economy we have seen auctions picking up again with more useful, new and everyday use items. Over the last 30 years I have seen auction prices skyrocket on antiques and collectibles but due to the down economic times they are bringing less money than they have in the past. A lot of people are not selling the more expensive items because the buyers are holding on what money they have for basic things.
We have switched gears to selling more of these necessities because that is what people are using every day. At my last auction we had canned and other food products for better prices than you will find in the local retail stores. We have one hauler that will bring in frozen meats and other food items.
If you don’t think that things are down just look at GM who sent over 200 of its one-off and historic cars to the auction block this month. More people are selling items that they don’t need to increase their income. I have seen old sellers going back into the business of buying and selling at auctions in the past year also.
Types of Auctions & Terminology
Here in North Carolina all auctions are with reserve unless the personal or real property are in explicit terms put up without reserve.
1. Auction with Reserve
The auctioneer may withdraw the goods at any time until he/she announces completion of the sale. The goods may be put up subject to the seller's confirmation or subject to a certain reserve price. At an auction with reserve the seller has the right to reject or confirm a bid.
2. Auction with Reserve and the Seller Reserving the Right to Bid
The auctioneer may withdraw the goods at any time until he/she announces completion of the sale. The goods may be put up subject to the seller's confirmation or subject to a certain reserve price. The seller, or someone acting on the seller's behalf, including the licensee, may bid, provided that full disclosure has been made that liberty for such bidding is retained. A licensee shall not knowingly receive such a bid without this full disclosure.
3. Absolute Auction
It is the auctioneer's and the auction firm's responsibility to make sure that the seller fully understands the law regarding absolute auctions. After the auctioneer calls for bids on an article or lot, that article or lot cannot be withdrawn unless a bid is not made in a reasonable time. An auction without reserve means an absolute auction.
4. Buyer's Premium
A fee charged to buyers at some auctions. The buyer's premium is a percentage that is added to the last or final bid amount to determine the actual selling price.
5. Personal Property
Title for personal property sold at auction passes when the auctioneer accepts the final bid and announces the item sold (at the fall of the hammer).
6. Real Property/Real Estate
Land and all interests therein, including all improvements to the land, such as buildings, fences, and fixtures. Title for real estate sold at auction passes at closing with delivery and acceptance of the deed.
7. Auction Contract or Agreement
The agreement between the auction firm or the auctioneer and the seller (or his/her agent) where the parties agree to the offering of certain personal or real property for sale at auction as set forth in the contract.
8. Auction Sales Contract
The agreement to sell and buy certain goods between the seller and the buyer, with the auctioneer acting as the seller's agent. The majority of auction sales contracts for personal property are oral when the auctioneer announces the item sold or by the fall of the hammer. All auction sales and purchase contracts for real property are required to be in writing.
Additional Info:
I conduct auctions at 7pm on the 2nd, 3rd and 4th Friday nights at the Ranger Community Center just west of Murphy, NC.
Our auction is family oriented and fun for everyone. No Buyer’s Premium. And don’t worry about getting dinner because Sheri has great home cooked food and drinks at the sale. See You at The Auction.....
